Probable CauseOn 7/3/18 at approximately 1305 hours, Officer Palcher was called to the lobby of the Brainerd Police Department to take an assault report. Palcher was informed that a mother had come to the police department to report that her daughter had been assaulted and was now admitted to the hospital located in the City of Brainerd, County of Crow Wing, State of Minnesota.Palcher then met with the mother, C.J.G and her boyfriend A.E.M.. C.J.G. identified the victim, her daughter, as K.A.G.. C.J.G. explained that her daughter K.A.G. has been in a romantic relationship with a male subject identified as Nicholas Theodore Balsimo, DOB 11/22/1989, herein Defendant. C.J.G. said the relationship is currently involving drug usage and violence related to Defendant assaulting K.A.G. C.J.G. and A.E.M. reported that on the afternoon or evening of Saturday, 6/30/18, they received a phone call from K.A.G. saying she was at Cub Foods in NE Brainerd and needed them to come and pick her up. C.J.G. said in general terms K.A.G. admitted to her that she had been significantly assaulted by Defendant. C.J.G. brought K.A.G. to the Essentia Health St. Joseph's Hospital in Brainerd to be treated. As of 7/3/18, K.A.G. was admitted into the intensive care unit at Essentia Health St Joseph's Hospital with internal organ injuries.C.J.G. stated that K.A.G. has protected Defendant in the past and has not been forthcoming with information about assaultive behavior in their relationship, but that they have witnessed things that show abuse. The same was true in this particular incident when K.A.G. told her that Defendant hit her but she would not elaborate further C.J.G. was not certain where this incident took place other than K.A.G. stating she walked many miles to get to the Cub Foods in order to call.Palcher advised Brainerd Investigator Thesing of the assault and that the victim was in the Essentia Health St. Joseph's Hospital. Thesing responded to the Hospital with Brainerd Investigator LaVoy to speak with K.A.G.. K.A.G. advised she had been admitted to the Hospital on 7/2/18 after having been punched in the stomach her ex-boyfriend. K.A.G. advised she suffered a ruptured spleen as a result of being punched in the stomach. K.A.G. claimed she was homeless and did not know the address where the incident took place, but described a residence on a road off of Wise Road.K.A.G. was reluctant to provide the name of her ex-boyfriend. K.A.G. admitted she was dating Defendant but claimed she broke up with him prior to this assault, now changing her story to being assaulted by a friend.After Thesing reviewed the medical records, Thesing learned K.A.G. was seen at the Essential Hospital on 6/30/18 immediately after the assault. After additional follow up by the Hospital on 7/2/18, records indicated K.A.G. sustained a splenic injury from the above reported assault.On 6/7/18 Thesing met with Defendant at the Crow Wing County Jail, read Defendant his Miranda Warning and received the following from Defendant; Defendant had been in an intimate relationship with K.A.G. since last year. Defendant advised on 6/30/18 K.A.G. was with him at a residence on Terratrac Road. Defendant said K.A.G. was complaining of stomach pain and Defendant made arrangements to take her to the Hospital. Defendant claimed there was no altercation that took place before taking K.A.G. to the hospital. Defendant said he later got into an argument with K.A.G. and dropped her off at Cub Foods. Defendant claimed he never punched K.A.G. in the stomach.Defendant has two prior Assault convictions; a Misdemeanor Domestic Assault conviction in 2014 and a Misdemeanor Assault 5 conviction in 2009.
